Dimora trial: Defense motion for mistrial denied

AKRON -- A defense motion by attorneys for Jimmy Dimora for a mistrial was denied by U.S. District Judge Sara Lioi at the start of court proceedings Thursday.

The discussion took place at a sidebar conference with Lioi and Dimora's attorneys Bill and Andrea Whitaker, and Michael Gabor's attorneys Leif Christman and David Oakley.

After the private sidebar, Lioi addressed the courtroom and simply said that "the defense motion for a mistrial is denied," and then court continued.

Lioi did not reveal what the grounds the motion for mistrial was based upon.

Just after 9 a.m., Christman began presenting closing arguments for his client Michael Gabor.

Jimmy Dimora's co-defendant Gabor, 52, of Parma, was charged with 8 crimes in the indictment handed down Sept. 7, 2011.

They include: 1 count of aiding and abetting bribery, 1 count of conspiracy to commit bribery, 1 count of aiding Hobbs Act extortion, 1 count of conspiracy to commit a Hobbs Act conspiracy, 1 count of aiding and abetting mail fraud, 1 count of conspiracy to commit mail fraud, 1 count of conspiracy to obstruct justice, and 1 count of RICO conspiracy.

Gabor was charged in counts 1, 17, 19, 21, 28, 31, 32 and 33.

Both Dimora and Gabor have pleaded not guilty. Hobbs Act is a federal law that prohibits actual or attempted robbery or extortion affecting interstate or foreign commerce.

Below is a summarized account of the charges against Gabor.

Count 1: RICO (racketeering) that Gabor and Dimora ran a criminal enterprise and Dimora accepted bribes for county policy decisions. Gabor is accused of being a go-between, as well as paying $10,000 to try fix his divorce case before Domestic Relations Judge James Celebrezze.

Count 17: Conspiracy to commit bribery concerning programs receiving federal funds for bribery involving Gabor, Steve Pumper and the HUD-financed Parkview Apartments project

Count 19: Bribery concerning programs receiving federal funds, for bribery involving Gabor, Steve Pumper and other county projects

Count 21: Hobbs Act conspiracy for bribery involving Gabor and Steve Pumper

Count 28 : Conspiracy to obstruct justice for conspiring with Gabor and others to obstruct the FBI's county corruption investigation

Count 31: Conspiracy to commit mail fraud and honest services mail fraud for bribery involving Gabor and Joseph Gallucci

Count 32: Mail fraud and honest services mail fraud also for bribery involving Gabor and Joseph Gallucci

Count 33: Conspiracy that also involved Gabor
