WILLOUGHBY -- Authorities say the driver of a pickup truck was intoxicated when he pulled into the path of officer Jason Gresko's police cruiser on Sept. 21.

Willoughby Police Chief Jack Beckwith says toxicology results show the pickup driver had a blood-alcohol level of .14 at the time of the Sept. 21 incident.

Officer Gresko, who was responding to a call for assistance with his emergency lights activated, swerved to avoid the truck and crashed into a tree on Harmony Lane.

Gresko, 32, died as a result of the accident.

The situation will be presented to a Lake County Grand Jury this Friday to determine if the driver will face charges.

The driver's name has not been released.
