AKRON -- An Akron teacher facing possible termination over a picture posted to Facebook has requested an employment hearing to plead her case to an impartial referee.

The district placed the Buchtel Community Learning Center math teacher on leave on Oct. 19. That's when the district says it was informed of the Facebook post. According to the district, the post on the teacher's personal page featured a photo of some her students with duct tape covering their mouths and the caption "Finally found a way to get them to be quiet!!!"

Akron Public Schools says the photo was taken during class time when the students should have been learning. Another teacher alerted the district to the photo.

On Jan. 14, the APS school board voted to consider firing the teacher.

A referee will be chosen to hear the case. Their recommendation will be given to the school board for a final vote.
