AVON LAKE -- Brecksville resident Anthony Rose, 50, will spend five days in jail -- a 90-day sentenced with 85 days suspended -- for striking and killing bridge painter Peter Maglis, 63, back in September.
Rose had earlier pleaded guilty to vehicular manslaughter and failure to keep an assured clear distance.
Aside from spending five days in jail, Rose was fined and also given community service.
Police say Rose was driving westbound on I-90 in Avon when the car in front of him braked suddenly. Rose's vehicle struck the car then swerved through the orange barrels, hitting Maglis.
In court Tuesday, Rose apologized several times for the accident.
In his defense, an Avon police officer noted that Rose stopped after the accident was very upset and remorseful.
Avon Lake Municipal Court Judge Darrel Bilancini said there were questions about improper speed limit signs in the construction zone near that Nagel Road interchange.
