SOLON -- Cuyahoga County Prosecutor Timothy McGinty has determined that the case is closed and no action needs to be taken against two Solon officers who killed a man March 17 during a 9:45 p.m. traffic stop in Solon.
McGinty said in a release that after "reviewing the BCI and Solon Police Department investigations surrounding the March 17, 2013, shooting of 22-year-old Kevin Bailey by members of the Solon Police Department...concluded that the facts do not warrant any further investigation or action. This matter is now closed."
Solon police officers Steven Davis and Nicholas Kline shot and killed Kevin M. Bailey, 22, of Sylvania Township, after he opened fire on them during a traffic stop on Bainbridge Road.
Bailey tried to escape from police and turned down Sunnywood Drive, where his car went over the curb and became damaged. Davis and Kline were in pursuit but before they could get out of their cruisers, Bailey began shooting at them.
They returned fire and Bailey was pronounced dead at the scene.
Both officers were also struck bu bullets.
Davis was struck by bullets in the chest and left arm, but he was wearing a bulletproof vest. Both officers were taken to the hospital, where they were treated and released.
