AKRON -- A judge has sentenced an Akron man to 29 years in prison for the attempted murder of a Marine at a gas station.

A jury had convicted 21-year-old Breshaun Nichols on all charges including attempted murder, aggravated burglary, and felonious assault in May.

On June 13, 2008, Marine Richard Dawson stopped at a gas station on Arlington Road for gasoline and a soda. Nichols followed Dawson back to his truck and demanded his wallet.

When Dawson refused, Nichols shot him in the stomach. Nichols then aimed the gun at Dawson's head and pulled the trigger, but the weapon jammed Nichols then fled in a car driven by his brother.

Summit County Prosecutor Sherri Bevan Walsh said she was satisfied with the sentence given to Nichols. " Clearly the defendant does not belong in our community and I am pleased that he will be in prison until he is 50 years old."

The brother and another male friend in the car pleaded guilty to lesser charges. A female passenger in the car was not charged.
