OLMSTED TWP -- The 81-year-old woman behind the wheel when Charlie Kho was fatally hit by a car won't have to serve any prison time.
Monday, a judge sentenced Helen Fettes to five years' house arrest and suspended her driver's license for life.
Fettes also has to pay $125,000 to the Kho family in restitution.
Fettes pleaded no contest in November, to charges that she hit 13-year-old Kho while he and some friends were hand delivering party invitations in October 2011.
Fettes drove off, and police say she later tried to cover up the damage to her vehicle by trying to pay for repairs with cash.
A Ganley repair shop manager suspected Fettes and called police.
Charlie died the day after the crash, on his birthday.
The 81-year-old woman could have faced up to six and a half years in prison, and Kho's parents were hoping the judge would issue Fettes to spend some time behind bars.
Her sentencing to house arrest left the child's relatives sad and angry.
"She's not even getting a punishment. She's getting to stay in the comfort of her home, and have her family come visit her. She gets to see her grandchildren. We didn't even get to say goodbye [to Charlie]," said Cassandra Moscalink, Charlie's maternal grandmother.
Charlie's mother and father each gave statement before the judge, speaking to the loss and emphasizing that the accident became a crime when Fettes fled the scene and tampered with evidence.
Moscalink says, after 15 months of pain, the sentencing does not bring the family any closer to finding closure.
"I really thought she was going to get some kind of time. They would have been happy with 180 days. Six months. But that lady will not spend a day in jail. Nothing," Moscalink said.
