One will get his job back, two others will have their former ranks restored
CLEVELAND -- An arbitrator has ruled that a police sergeant fired following a deadly 2012 police chase must be rehired and two demoted supervisors must have their ranks restored.
Timothy Russell and Malissa Williams died following the chase Nov. 29, 2012.
According to the arbitrator's ruling:
Michael Donegan will be reinstated to the department effective July 11 as a patrol officer. He will receive back pay at the patrol officer rate from the time of his termination until his reinstatement. He will remain a patrol officer until July 11, 2015, when he will be re-promoted to sergeant.
Paul Wilson will be demoted for a period of 13 months (ending July 11), when he will return to the rank of lieutenant. He will not receive back pay.
Ulrich Zouhar will be demoted for a period of 13 months (ending July 11), when he will return to the rank of captain. He will not receive back pay.
The city of Cleveland released the following statement:
"We are not happy with the arbitrator's decision. We believe the decision is wrong, and we will appeal."
