Cutts Trial Verdict: Your questions

Now that the verdict has been read in the Bobby Cutts, Jr. trial, what questions do you have as the trial moves into the sentencing phase?

I believe that he should have been convicted Guilty for the Aggravated Murder of Jesse Davis and that it is not possible for someone to accidentally strangle a person on purpose during a fight.

A prisoner costs $20,000 a year -- but a death sentence costs millions in appeals and due process ... life in prison can be cheaper.

What in the world was the jury thinking???? If anyone has ever deserved the death penalty, this is the guy. Did they evade the aggravated murder charge because he didn't seem to have a "master plan" for the murder, because of his testimony, or were they privy to some information the rest of us didn't have? The jury needs to be polled and asked to explain why they voted as they did.

I believe the jury did a good job in coming up with the verdicts. As for the death penalty, it shouldn't come down to dollars and cents, it should be punishment that fits the crime. He murdered his own unborn daughter - that is not forgivable!

Ok, Not guilty of aggravated murder, but guilty of Aggravated Burglary.

Count 4--Aggravated Burglary for with the purpose to commit murder, trespassing into Jessie Davis' home:GUILTY

"For the purpose to commit murder" - umm, so how do those two NOT go hand in hand?

Hope he FRYS!!!

Poor sniveling guy, kills her (supposedly on accident), and YET hides the fact, and YET buries her body, and YET tells NO ONE, and YET throws her cell phone out the window - he must think EVERYONE is stupid like he is!

The question is – how could he have left his son alone for days after he murdered her and dumped her body in the woods? How could he have allowed his family and her family and strangers suffer and search for TEN days while she lay rotting? The answer is because it was all about him. HE only thought of himself. Even if she was “accidentally” dead they might have been able to save that baby. But HE didn’t want to pay child support for any more kids. He was sworn to uphold the law. He should receive the death penalty for his disregard for life. He will answer to God in the end.

I think the reason why the jury convicted of aggrevated murder of Baby Chloe and not Jessie was due to him not calling 911 and asking for help. Even though Jessie had passed, the paramedics could have possibly saved Chloe, if he had called them. He may not have intended to kill when he went into her house, but the act of neglecting to call 911 reflects intent to kill, in my opinion.

Justice has been served. Jessie and the baby can now rest in peace. It breaks my heart to know little Blake will never have the opportunity to be with his beloved momma. I believe Patty Porter and Ned Davis know that Jessie is with them through Blake. He is so very precious.
Booby Cutts should spend the rest of his life in prison. Forget the death penalty and don't waste taxpayer's money on appeals. As much as justice is served, the criminal still has all the rights to appeal and so forth. We can't bring Jessie back, and during the sentencing faze, I hope the jury sends him away, and not include the death penalty. My blood too runs cold, Bobby Cutts is a sociopath not crazy but no conscience and a borderline personality also.

Great Job Jury! I see the logice behind not finding he pre-meditatively killed Jesse. Anyway, it makes no difference, he will spend the rest of his god given life being abused in prison as a punk ex cop who sent a lot of people away. I dont want him to die, let the other prisoners give him his just due.

There's what the prosecution says, what the defense says, and what Bobby Cutts Jr says. Somewhere lies the truth. In any event, he was found guilty of two charges that carry the death penalty. The jury seems to have taken their job very seriously, and hopefully will continue to. Mitigation phase will be crucial. Pray for Jessie's family.

What I dont understand is how the jury can claim Cutts to be NOT GUILTY of the aggravated murder of Jesse Davis while they claimed him to be GUILTY of aggravated murder of her unborn child. Wouldnt those two verdicts go hand in hand? How could he be not guilty of killing her (premeditated) but guilty of the (premediated)killing her baby? Regardless.....the jury did what they were supposed to do in this case.... they ruled in a way which insures that he is going to prison for a long long time with the possibility of the death sentence looming over him. Good job jury, you did the right thing.

actually, i have more of a question... how are you "guilty" of aggravated burglary - which stated "the intent to commit murder" but not guilty of aggravated murder? If the jury believes he went there with the intent to kill then why did they convict him of the lesser charge?

I think the verdict was fair. I don't think that he went to the house with the intent to kill. I think he freaked out and killed her in a state of sudden rage, however, If he contacted an ambulance, the baby could have been saved. Why he would call her phone? To cover up the crime.

He could have saved himself if he just took the kid and left. He could have pretended that he picked up Blake as usual and act dumb

I was really appalled when I heard the not guilty verdict of Jessie. The evidence proves that he meant to kill her. I think he lied on the witness stand. There was more than a brief altercation at the door as Cutts testified. The room was in disarray and Blake said "mommy broke table" and "mommy crying". These all show that there was a fight...a struggle. He wanted both Jessie and the baby gone and probably Blake. I don't want to throw a stone and say kill him...I am not God but the evidence proves he is guilty of agg. murder of Jessie Davis. I hope the jury will be smarter in the second phase of the trial when determining sentencing.

To clarify, he's guilty of aggravated burglary based on Chloe's murder, not Jessie's. Read the burden of each charge and it will make more sense.

When they took so long to reach a verdict, I was so worried that they were going to let him get away with murder.

I can't even imagine how horrible Jessie's final moments were - dying at the hands of someone she loved. My thought is to let him rot in prison - amongst the general prison population. Then we might see from real tears from him once the prisoners get ahold of him!

Good job to the jury! May Jessie and Chloe rest in peace now.

I think the jury did the best they could, I think he should get the death penalty also. He was a Police Officer-sworn to protect and serve-he should be held to a higher standard. My heart broke when they found Jessie and baby Chloe in that park, all the things that could have been, poor little Blake. Bobby Cutts is a monster and it has NOTHING to do with race.. His punishment should fit the crime period-he shouldn't grow old on death row, he should go staight to the front of the line. I wanted to cry when I heard the verdict. May Jessie and baby Chloe rest in peace now.

Of course my thoughts and prayers are with the Davis/Porter family, but the Cutts family has them as well. Too often people ignore the defendant's family, or treat them as if they are the ones who committed the offense/crime, or worse are somehow to blame for the choices of their family member.

Jessie and Cloe are in my prayers and thoughts as well as the family.

Cutts got what he deserved, however I feel he should get the Death Penalty and not wait for years of appeals on death row. He admitted he killed Jessie and the innocent baby. Now give him the chair and move on. Why should he live when he did not give Jessie or the baby a chance to live??

Bobby Cutts definitely got what he deserved. Im glad that will he never see the outside of a jail or a court house again. My prayer goes out to the Davis family, especially Blake. He has not only lost his mother and his sister, but he has lost his father also. In his little mind he doesnt understand why both of his parents are gone. My prayers also go out to the Cutts family. Bobby Cutts has brought so much shame to them. God will deal with Bobby Cutts. Hopefully one day he will own up to what he did.

Give me a break on the race card and a break on the "It was an accident" - if it was an accident, he should have said that from the beginning, not waited until he got on the stand. He was able to concoct his accident story while listening to what the Prosecution's evidence was. He did it, has been convicted, now we wait to see what the sentence is and how long we have to support his butt in jail and pay his legal fees - I hope the jury gives him life in prison with no hope for parole - just think since he is a former cop - he will spend a lot of time by himself to think about what he did. I am big supporter of the death penalty and to put a "player" like Mr. Cutts in jail we will put one more "lets not use" protection baby maker and adulterer in jail.

I think life in prison without parole would be a greater punishment than the death penality. I watched an interview with Jessie's mother, Patty Porter where she stated that if the Lord can save her, He can save Bobby Cutt's as well, maybe life in prison will give him the time he needs to realize his own need. That's how I feel about it.

Can you have Avery explain the aggravated burglary charge? Where is the evidence that Cutts broke into Jessie's house rather than her letting him in? I understand all the other charges and the verdicts but this one in particular has me confused.

During the reading on his conviction he showed no emotion...much like he showed no emotion after he killed her and walked about for days acting like he was looking for her. He knows he did it, we know he did it... and in my opinion, he is only sorry that he got caught....

O.K. We knew he was guilty, I say put him with the general population in the prison system. A cop and a baby killer? If only that day could be on t.v. for all of us to watch. Believe me he's going to get his. Does anyone remember the cop years ago that was a child molester? They had him on death row and it took years but people got to him and he was peeing through a tube after that.They should hang pictures of jessie in his cell to remind him of his sick and calulated crime.

It is clear the jury felt the evidence produced no proof he intended to murder when he went to the home. At some point however he took a coarse of action that lead to death of bay Chloe. He had very little to say on the stand about what he thought after he could not reach 911 on Jessie 'turned off phone'. He could only confess confusion, but his actions showed a methodical attempt to conceal her death and disregard for his son once he was with Myisha. My prayers are with all involved, including Bobby.

Good .... the jury did an excellent job. Very costly to be put on death row or life in prison. All laws should abide by the "eye for an eye" theory. Have someone kick his ass, strangle him, the dump him in enclosure with wild animals to feed off his rotting corpse!

I think that the jury did a great job. They showed that they really weighed all of the evidence and came up with the right decision. I am not saying that I believed Bobby Cutts on the stand, but none of us know for sure what happened in that bedroom. But we know that even if killing jessie was not his immediate intention, not calling for help and letting Chloe die, was. My prayers are with both families, as well as the jury, who will be facing the hardest decision, Life or death.

I think the reason he was guilty of the aggravated murder for the baby is because if he would have called for help right away, the baby could have been saved. His neglect was a conscious decision to let his baby die and in my mind totally beyond unforgiveable.

I am thankful they found him guilty and he will never walk as a free man again.. but, if Bobby Cutts never takes the stand on Monday, he would have been found not guilty. The state of ohio did a terrible job presenting its case and had nothing at all that showed the jurors Bobby was the killer, dont get me wrong, everyone knew he was, but to convict, they needed evidence and they had none against him. I dont know why they put him there on Monday, but that was stupid on his part, but it sure makes everyone else happier that he did.

Excellent job done by the jury, now we just need the system to punish him to death and DO IT!! Not in 5, 10, 15 years but this year. All the appeals and crap is just that, crap. Jesse Davis and Chloe did not get any appeals, why should he? It should be an eye for an eye, there's NO explaination for "accidently" strangling someone to death, burying the body and leaving a toddler to fend for himself. Pathetic does not even discribe him...there are no words for the likes of Bobby Cutts, Jr.

It isn't clear how he was convicted of aggravated burglary when he was expected at the home, but not convicted of aggravated murder for jesse.In any event,sending him to death is too good for him. Put him in jail and let them have at it!

Maybe now, Bobby Cutts, Jr. will think back and decide if the cost of a condom was priceless. If anyone sold out Bobby, it was Bobby Cutts, Jr., and his apparent lies, manipulations in his own words on the witness stand. He is heartless and his acting job was nothing more than a ploy to save himself from the death penalty. Bobby got what he deserved. God Bless Jessie, Chloe and Blake.

I can only imagine what both families must be going through...sure he got convicted but it will not bring Jessie or Chloe back. When it comes to whether he should get death or not...Financially speaking, it would cost more for him to be put to death with all the appeals that he would get and let's face it, it wouldn't make things any better. In my opinion, he should be put in prison for life...stick him in there with the same people that he put in there as a Canton police officer and see how long he lasts...i can only guess that it wouldn't take much time before someone took matters into their own hands and ended his life.

I hope people can now move into the next process and that is to help his children deal with this awful tragedy in a positive way(what ever that may be).We need to pray for that family what is done is done, unfortunately but prayer can help the survivors!

Question: No one reported on the motion for a mistrial. I didn't quite understand why defense found the jury's verdicts inconsistent nor why the judge overruled the motion. Can you explain what happened in the court at this time?

I totally agree that Cutts should be sentenced to death, but not for an unborn baby dying and here's why.... Women kill unborn babies everyday and it's called an abortion and it is perfectly legal so to charge a man with murder of an unborn child is just wrong!! He's being charged for doing what women do everyday and that sexual discrimination, plain and simple. PLEASE do NOT get me wrong, I'm totally against abortion of any kind, but to allow one sex (females) to get away with killing unborn chldren and then to charge a male for it is wrong. It is a double standard based on a person's sex that the courts condone, but we as a society are not supposed to treat people differently based on their sex. Am I the only one that sees this?

Although I believe the jury got it right, no one wins. Blake has to grow up knowing his father killed his mother and sister. Not to mention Cutts' daughter grows up with her father being a murderer. He deserves the harshest punishment allowed for the lives he took, and, for those he destroyed.

sad; I feel nobody wins in a case like this, what makes a person who supposedly was loved by Jesse get to this point I fell these women need not get involved with guys like this now there is a little boy left holding the sins of his father and will never know his mother. People need not get into situations that cause this terrrible tragedy. I'm sure if you asked Jesse years ago if he was capable of this she would likely say never. I fell he knows what he is faceing and we can all speculate on what really happened but it is so sad for everyone left to move on. My fellings go to both families my heart goes out to you all. To the 6:10 pm comment: In my humble opinion, here is the difference - while I am VERY against abortion, it is done by the woman's choice. The life ends by choice. Baby Chloe had no choice. you did not address the loss of Jessie in this comment, so I will not; however, please understand you are comparing apples and oranges. The difference between abortion and what Cutts did is that it was not Jessie's choice to end Chloe's life; it was Bobby's. If Cutts was a female and did what he did, the charges would have been the same. It's not about the sex of the offender, but about the choice - Jessie did not make the choice to terminate her pregnancy -Bobby did. You are misguided, so I can't imagine others feel the way you do. Many will agree with you on abortion being wrong and immoral; however, I can't imagine any will agree with you that convicting Bobby Cutts is discrimination against his gender. Again, the conviction is not about gender but about choice. Make sense?

Cutts was so Full of Emotion during his Testimony:

~ His constant sniveling on the Witness Stand;

~ His choked up voice throughout Hours on the Witness Stand;

~ Minus his Tears during 95% of his testimony;

~ Repeatedly hiding his face in his hands so he wouldn't have to look at the Jury, nor the Prosecutor;


But, where did all that emotion go too while the Verdict was being read ??

And, my goodness.... Has this guy ever heard of buying a $5 Box of Condoms ??

He keeps having sex with all these different women & he keeps getting them all pregnant.

Every year from now on, he should be made to look at a picture of what his beautiful baby daughter may have looked like as she grew up through the years if he had only called 911.
He should never be able to forget what he did as the years go by. He should always see her face before he goes to sleep at night for as long as he lives.

this was a police officer "sworn to serve and protect the people". he should be put to death in the same manner as jessie and her unborn baby, and his body left in the elements for the same amount of time. then his family can pay thier respects. i know it is not their fault, but jessie's family had no say so in the matter either

I'm on the fence with the whole death sentence. I am for the death penalty, but in this situation it is a little different. A death of a parent has already extremely effected the life of an innocent little boy. In one way it is better for him to not know his father, but at the same time I think of how i would feel growing up and finding out that my father killed my mother. Even though he saw it, it won't register with him until he is older. I would want to confront my father about the situation. If he gets put to death we take away any opportunity for Blake to ever really know his father and confront him for what he did. In a way it is better for Bobby to suffer and have a miserable life in jail and to one day, have to explain himself to his son that saw the whole thing.

My heart is with the Davis and Cutts families.

I believe this was a great representation of how justice is supposed to work during this phaseof a trial. CONGRATS to the jury who was able to distinguish between murder and aggravated murder. I mean, come on, we ALL can reasonably assume that Jesse was strangled (which would indicate intent). However, the evidence was not there to prove it. The evidence only pointed to the fact that she probably was not hit in the trachea (because there were no broken bones), and she probably was not bludgeoned (there was not blood evidence). But during a trial, a jury is not allowed to ASSUME what happened...there must be proof beyond a reasonable doubt!! That was just simply not there in this case. I believe the judge and jury both in this case took their jobs very seriously. It's also good to know that it doesn't always matter who you are, you do the crime, you do the time!! I trust that whatever punishment is handed down will be appropriate. In my own opinion, I feel Bobby should have to sit in jail for the rest of his life thinking about what he did. Let him sulk over the fact that he won't be there to teach his own son to be a man...a man that he could not be. Let him sulk over the fact that he left all of his children father-less. Let him sulk in the fact that he let down a whole city...one that should be able to trust in their protectors, not wonder if they themselves feel that they are above the law. Let him sulk in the fact that his family now has to live knowing that their son is a murderer. And last of all, let him sulk in the fact that other inmates do not like cops and baby-killers, and jail life could become unbearable for him!

You are "Assuming" Bobby Cutts will tell his son the "Real" truth if his son, Blake, ever confronts Bobby Cutts regarding what his actions were when he killed Jessie Marie Davis.

How do you know Bobby Cutts will not just give his son another "Tear-Less" sob story 20 Years from now & make another attempt at spinning the scenario from his Jail Cell regarding how he killed Jessie Marie Davis just as he attempted (unsuccessfully) to do for the Jury ??

Bobby Cutts portrayed himself as a Whimpering, Little Victim for accidentally killing Jessie Marie Davis and then having to endure a Trial as a result.

Not always the most accurate, but Blake, upon reaching the age of 20+ Years, can always read the massive newspaper accounts, listen to all the Commentary, the Talking-Heads & Mental Health Professionals who have saturated the television airwaves regarding his Mothers Murder & his Fathers Trial then arrive at his own consensus.
