What was the racial composition of the jury? Did the jury seem more attentive to Cutts' or the State's lawyers closing argument? Finally, during Cutts' testimony, did the jury look at him or did the jury seem to have a hard time looking at him?
Cutts, Davis' boyfriend and father of her children, said he did not kill Davis. Instead, he claimed he arrived at her home and found her dying.
"He went to the scene. He saw Jesse Davis. She reached for his trousers. Her eyes rolled back and she died," said Canton Police Union Attorney Avery Friedman. "He panicked. He called a friend. The friend came over and assisted him in the removal of the body."
The above was taken from an ABC article back on June 25th. Were these types of discrepancies in his sory(ies) ever brought up during the trial?
How did the jury seem to react to the Cutts' testimony as it was happening? Did there seem to be an air of disbelief or were they showing signs of accepting what he was saying?

You've been there covering this entire trial. What does your gut tell you? How would ou vote if you were on the jury?
I know as a reporter you are supposed to remain neutral, but since you've been in the courtroom for the entire trial, have you developed any feelings either way?
If he isn't found guilty of intentionally killing Jessie then can't he be found guilty of intentionally killing Chloe? If it were an accidental death of Jessie then there is a certain amount of time that Chloe would have remained alive after Jessie died. If he would have called 911 like any other normal person would have done....then baby Chloe would still be alive!!

You're in Canton, so it's Market Avenue, but I think technically the courthouse address is Tuscarawas Street West.
How about an interview with the court reporters? Ask them how 'trying' this was.
Why was Bobby Cutts not questioned as to the reason why he did not save his baby girl after realizing and knowing that he "accidentally" killed Jesse? If Bobby did not deliberately kill Jessee, leaving the baby to die would be first degree murder. If this issue was already discussed I missed that part of the news.

As I sit here pondering the outcome, I look back at your blog. Bobby Cutt's knows the court system and played his hand. I wish the judge would have included voluntary manslaughter. This alleged criminal Bobby Cutts and his defense team knew how to get this man off, by the legal jargon.
It sickens me to know that because the jury is locked in by two verdicts. The faith in our legal system at best is mediocre. I also felt Jessie Davis was on trial. The victims continue to have no rights, especially dead ones. Thanks for your excellent reporting, Chris.

There seems to be a question on the possible verdicts. One source states that only aggravated murder can impose the death penalty, where as if a guilty plea for just murder, the defendant can only recieve life in prison, please clearify....thanx

Twelve jurors will weigh in, six back-ups are here "just in case". The twelve primary jurors are white. Six men and six women. There is one African-American individual who is a back-up. From what I understand they are third in line to fill-in.

The statement of the Canton Police Union attorney runs slightly counter to Cutts' testimony from Monday. Cutts says he accidentally killed her by swinging his elbow and striking her in the throat. Also, contrary to the comments made on June 25th, Cutts claims Myisha Ferrell (the friend) never came to Jessie's house. Cutts claims he went to her house and picked her up

The best barometer of the jury was the questions they asked after testimony wrapped. They seem to have very thoughtful questions. To be honest, I was not watching the jury. We are in a neighboring courtroom that has been relegated for media use, so I was unable to see the jury; and the camera feed we are getting does not show the jury (for obvious reasons).

Great job of coverage. I can't help but agree with a few of the other statements regarding the death of Chloe. Was this ever discussed during the trial? I thought in Ohio it was also considered a second murder if the unborn baby died too. Any thoughts?

wasn't Jessie a little shorter than Bobby Cutts? Did they ever bring up the implausibility of his elbow connecting with her throat since he says he drew his arm straight back? If he did it would hit her in the nose or eye not the throat. And don't you immediatly turn around when you accidentally just bump someone and find out if they are okay? I do. Why didn't he turn around and ask if she was okay right away? After all he must have at least "liked" her if he had 1 child with her and they were expecting another, don't you think?
I say guilty on all charges.

Great job covering this story. My question to you is this, was it ever brought out about what Blake said to the police and his grandmother about "mommy was crying" and "dad is mad"? Also have you heard anything from the court house as to if the jury has asked for differnt evidence brought to them, or any questions coming from the jury room?
As for the charges, the jury can find him guilty of aggravated murder on one charge and not another. They can find him not guilty on aggravated Murder on Jessie, but find him guilty on aggravated murder for Chloe. They have all options at their disposal.

I would love to talk with the court reporters in this case, but the Judge, his staff and the attorney’s for both sides are under a gag order. I can tell you that on more than one occasion they have asked witnesses to slow down or speak up. They are taking copious notes on this, and when it is done, I’ll inquire about their thoughts!

He was asked repeatedly why he didn’t call 911 to help Jessie or unborn baby Chloe, and the answer was pretty consistent: I panicked, and didn’t say anything because no one would believe me. He says he knew he could have helped them, but didn’t.

The only way the death penalty becomes a possibility is if the jury comes back with a guilty verdict on aggravated murder. There are three counts of aggravated murder—one or all of them opens the door to the death penalty. If they come back with the lesser charge, murder, then death is off the table and the parameters would be a sentence of fifteen years to life.

Cutts is charged with three counts of aggravated murder. One is for the death of Chloe, another for baby Chloe and the third is for terminating the pregnancy of a viable baby. So, while there wasn’t an overwhelming amount of testimony on Chloe, her death counts for two charges, where Jessie’s counts for one. It is tricky, but Ohio law in essence doubles the potential punishment for killing an unborn child.

There was some lengthy testimony calling into question Cutts’ story of how the 6’4 man swung his elbow back, and struck the 5”4’ woman in the neck. Prosecutors hammered home on this issue, arguing that it doesn’t add up. Prosecutor Dennis Barr said “It just doesn’t make sense, given the height discrepancy, he should have hit her in the head, not the neck.” Defense attorney Fernando Mack argues that Cutts’ elbow was angled downward, which lead to the contact at the neck, instead of a straight back blow which would hit the head.
I am watching this trial with great interest from MD. I was brought up in Canton and follow the local news
Having said that, I served as a juror on a criminal case. The prosecution presented three-eye witness to the robbery, plus other testimony and the verdict ended up with NOT GUILTY. I was the final holdout for guilty, but caved in when 11 others thought the police mishandled the case. After it was over, I spoke with the police and they said this particular defendant, had been brought back from prison to stand trail. Extra security had been put in place at the courthouse, as he was deemed extremely dangerous. They said he was one of the worst of the worst and they felt he had committed murder at one time. Since then and this was in the early 80’s, he has been incarcerated for killing someone in the prison system. So, you just never know how juries see things. Hopefully this one will result in a guilty verdict.
Okay...let's give him the benefit of this for a second....say he did hit her in the neck....could that have possibly broken her neck? Is that possible?
Any questions I may have had - especially with regard to your take on the jury's reaction to Cutts testimony - have already been asked - I am sure you have to reserve your response to those questions until it's all over. I thought you would be interested to know how far reaching your coverage is...I am located in the most northeastern county in Georgia (in the N Georgia mtns)...I have followed this case since it happened and appreciate being able to have the updates on the trial by you. I happened to be near a TV when Cutts began telling his version of the truth on Monday...it was difficult to watch as it was apparent immediately that it was a very poor acting performance and skipped most of it and relied on your report to get the details. I was imagining Jessie's family having to sit thru that and not react - how painful for all of them. Tho it won't bring Jessie, Chloe - and Blakes mother - back, hopefully Cutts will not be free ever again to hurt anyone else nor father any more unwanted children. Okay, how does a 6'4" man angle his elbow downword enough to strike a 5'4" woman in the throat with enough force to kill her without aiming right for a specific part of the neck? With a difference that great, I would think you would have to aim for her throat, I have to agree with prosecutors that he grabbed her around the neck with his arm. One of the ladies here at work made an interesting observation. Wouldn't someone immediatly try to save the baby when you see that Mom is dead?
and another asked why didn't he use his phone to call 911? Did they address that?
I am watching from Michigan and mostly on court-tv or tru-tv as it is now called but at 3pm it goes to regular programing and I really dislike that..so I turn to your blog to get updates after searching for news from Canton,Oh....You are doing a great job.....
It blows my mind that someone trained to save lives did such a horrible thing but I am convinced he truly premeditated her murder....Not one thought about that he was also killing his child except to get rid of what was going to cause him financial hardship....

When Myisha testified, what exactly did she say about Bobby using his arm? If she didn't actually say the word "strangled" then it seems like Bobby had several days to come up with yet his next lie to explain away the damaging testimony. What are your thoughts?

Does this jury think it is as ridiculous as we do that Cutts implies to have "accidently" killed Jessie by an elbow to the neck? How did the jury seem to react to his absurd nonsense story? Did the prosecution rip it apart more than what is shown? Did the defense indicate when we were supposed to believe Bobby and when no to?
Am I the only one who thinks you can't kill a person by an elbow to the neck? Why wasn't more made of that Chris? A blow to the neck wouldn't kill Jessie, unless Bobby was some martial arts expert (NOT). Do you think most people get this?

You have been there the whole time, what is your opinion? If you could, despite covering this for almost a year, remove yourself from it would you think the evidence was there for a conviction?
You actually can kill a person with a blow to the neck, especially with a blow to the front of the neck. It takes some force but it is doable and easy. Crushing the windpipe at the front of the throat takes little more than one sharp blow. There is no evidence here that speaks to premeditation. The prosecution really failed in that part.
I disagree - the prosecution was very clear in explaining that premeditation doesn't mean he had to go there with the intent to kill her, he just had to have intent right before the moment he killed her. You are mistaken. Premeditation was clearly defined by prosecution.
I would just like to say that, I have followed this story from the very beginning. I am too a single mom with a little boy and what happened to Jessie is my biggest nightmare! I was there to help search for her and the whole time it seemed that everyone kind of knew that he did it. We even had a conversation on one of the busses that day that "if he did do it, why would he let so many people get involved and look for a ghost?" There were so many people out there that week and every business sent their regards through their businesses signs....it was one of the most heart wrenching things I have ever witnessed. My heart goes out to Jessie's family and Bobby's family. They all have lost in this situation. As to how he killed her? People don't accidently die from getting hit in the neck. It just doesn't happen! And if Bobby doesn't get the death penalty then I believe he will have it even worse for a longer period of time when he goes to prison. Men in prison don't like cops or baby killers.
actually in the closing remarks by the prosecution it was stated that a physician who was testifying said that a blow to the neck would not likely cause death. i wonder why the prosecution has picked up and stuck with the strangulation theory anyway. he took a pillow with him, and threw it away. what if he soffocated her with that pillow? and wanted to destroy any dna evidence of her saliva on it? why would that not seem possible? i can only assume they came up with the strangulation theory due to myisha ferrell's testimony. is it a requirement that the prosecution have a specific, concrete theory as to what bobby cutts jr. did?
In the case of Scott Peterson they do not have absolute concrete evidence as to how Laci and Connor died, yet he's sitting on death row.

We have never heard that Jessie’s neck was broken. In fact, there is no definite answer to how she died. The coroner says based on her badly decomposed body, she sustained injuries consistent with strangulation. But, nothing was ruled in or out.

Jogot, they spent quite a bit of time on the height discrepancy, and how it may impune Cutts’ version of events, but there was no expert on the matter, or witness testimony on the matter. It wasn’t introduced until the last witness took the stand (Cutts), and there were no rebuttal witnesses called to refute it.

Myisha did not verbalize anything when it comes to how Bobby described the neck region. She motioned or simulated what looks like an elbow around the neck; she testified several days before Bobby walked the jury through his version, so she didn’t have to clarify Cutts’ take on things.

i wasn't as up to date on the scott peterson trial. that is encouraging to know, however. maybe the jury will ignore the hype about the prosecutions assumptions and just go by their "common sense" as to the chain of events. i missed myisha ferrell's testimony. i looked and looked for the video clip last night and could not find it, only the video clips of bobbie cutts jr. can someone give me the link to it? it is the only piece i have missed, and am really interested in what she had to say. it will likely enforce my thoughts about where bobbie cutts came up with all of his story, to explain away every single last detail of everyone else's testimony. at any rate, if anyone has the link? thanks.
if he says he didn't mean to do it why wait 9 days to tell them where the body was, but as a police officer i'm sure he knew how long a body would last out in the heat before it started to decay come on he's guilty and should get death just like jessie
I hope this wouldn't be another Simpson trial. Everyone knew he was quilty and he got off scout free......how can someone kill his own child besides the person he had feelings for............hope he gets what she deserves and then some
I've been on two jury trials and you would be surprised how "by the book" both experiences have been. No one ever talked about the trial during lunch breaks, or bathroom breaks or at anytime before deliberations. Even then, it has only happened in the jury room.
Most people see jury duty as a serious responsibility and treat it with the decorum it deserves.
Chris - you deserve a merit badge for this moment to moment coverage and I am sure, when this is over, you will continue on it for a good bit. Not a 9 to 5 job is it?
I would also like input as to this black mark on this particular policeman should not- ever, in any way - make a black mark on all cops. Not even close to impuning their integrity - as a group of officers who help each of us in many ways, they don't deserve this attempt at tarnish.

I would liked to have seen the prosecutor ask Cutts if as a police officer (ex) how plausible would his own story sound to himself. If he was investigating this case and the boyfriend was relating to him the series of events that happened. What would he think? He would either have to admit that his story sounds totally ridiculous or say he could believe his own story and look like an idiot.
who decides the number of years cutts would get in prison in the case that he is charged with just murder and not aggrevated murder? the articles say if he is charged with murder he could get 15 years to life. who makes that call? the judge? or does the jury also decide how many years he would get?

The LAW Book decides the Sentence Cutts will have to serve if he's convicted of Murder & not Aggravated-Murder - Not the Judge.
15 Years-to-Life does NOT mean a 15 Year Sentence.
It means he would have to serve a Sentence of LIFE & After 15 Years, Cutts may "Ask" the Parole Board to be released for the first time.
It does Not mean Cutts will be released in 15 Years - ONLY that he may "Ask" to be released.
Remember - the Sentence is LIFE.
PS. (No one gets released for murder on their 1st time asking the Parole Board)

what a relief. thank you so much for clarifying what 15 years to life means. i would hope the parole board would not grant him parole after 15 years! someone mentioned earlier, and i think i agree, i think life in prison could be worse for him than death, as prisoners do not like baby killers. i doubt he'd get solitary confinement or anything, but in my mind that would be the WORST punishment of all, solitary confinement for life. how horrifying.
i do not understand completely about the three aggrevated murder as compare to two, but i think the baby counts as two, one for terminating the pregnancy, then the other for killing a child under the age of 13. i'm not sure if that's right.

For those of you weighing in on the role of the jury and how “by the book” things go in these kind of deliberations—I am fascinated. I wonder if one would rather be on the jury of a big case like this one, where the stakes are high and the story is compelling; or, if you’d rather be on a more trivial case. I am sure this jury is doing it “by the book”, they are also doing it on bankers hours. In at 8:30, out by 5:30. Those of us in the press tag on another five more hours a day---getting to and from the court and posting our stories. We’re not looking for sympathy mind you, but it is not always a glamorous assignment. There are more than a few coughs, colds and infections moving around the media room, where most people aren’t eating right, aren’t working out, or getting much sleep. There is some restlessness among the folks you see and read covering this case.

Chris, have you ever been on jury and deliberated? I was on serious sex crimes trial in Cleveland. There were things not covered by thge prosecution and we were in the room for 5 days. We had one juror say they could not remember things and wanted to have the transcript. We got more documents from the pretrial that showed us things we should have been told, ie prior convictions. We then had a juror say she sat in the back and could not here much. She wanted to vote one day guilty on rape if we would vote innocent on abduction. We ended up being hung due to this one person. Incidentally, the first vote was 11 guilty and 1 innocent. I was the one alone based on no dscussions before the first vote. At times it was like the twelve angry men. Thanks for your coverage. I had a broken lef and saw all of the OJ trial. He was covering up for someone else.

The three (3) Counts for Aggravated Murder are:
1 Count - Death of Jessie Marie Davis
1 Count - Unlawfully Terminating a Pregnancy
1 Count - Causing the Death of a Viable, Unborn Child Under 13 Years of Age
Aggravated Burglary does Not mean "Stealing/Taking" something from the scene.
It means Cutts "Trespassed" into Jessie Marie Davis' home & Inflicted Physical Harm to Her and/or her Unborn Child.
Even if Cutts was Given Permission to Enter Jessie Marie Davis' house, that permission is Revoked (whether she tells him to get out or Not) once Cutts commits any Violent Felony against her.

I would like to know if the jury finds him innocent on the murder charges, can he then be arrested for voluntary or involuntary manslaughter, or does he just walk away from those charges all together?

It was mentioned earlier Cutts would suffer worse if sent to prison instead of Death Row due to Cutts being a "Baby-Killer."
It was also mentioned that it was doubtful Cutts would have to serve his sentence in "Solitary Confinement."
Actually, Cutts will be considered a "Police Officer" inside prison which is far worse than being considered a baby-killer & therefore, Cutts will have to serve his Sentence in "Protective Custody."
Prisons conduct their "Protective Custody" Operations two (2) different ways:
#1 - Solitary Confinement;
(Inmates remain inside their Own Cell 23 Hours per Day & 1 Hour of Exercise by themselves in a courtyard alone)
#2 - All "Protective Custody" Inmates Housed Together in Separate Facility on Prison Grounds;
(This means all child-molesters, baby-killers, child-killers, high-profile inmates, homosexuals, law enforcement officers, etc. are housed with each other. They must share their Cells together & share the Exercise Yard together)

Cutts is an officer of the law. What was he thinking? No matter how this happened, he let the mother of his children and a child of his DIE. He got no help for them! For that reason alone, he needs at least, a life imprisonment. How do you NOT get help for a dying or hurt child? What a selfish and uncaring human being this Cutts is.On top of the 2 deaths he caused, he left another of his own children ALONE, in a bleach filled house. I am truely struggling to find any reasoning behind his actions, or his lack of, I should say.

There should not be any protests since atleast two (2) Attorney's on Cutts' defense team are African-American themselves & they obviously signed-off on the all-white Jury.
"Peremptory Challenges" are used during the Jury Selection process to Remove a Potential-Juror for Any Reason without the Attorney having to explain themselves ~ No Questions Asked. Both sides are given approximately 20 Peremptory Challenges each.
So if the Defense has any left over after the Final Jury has been selected, that means they could have continued to use their Peremptory Challenges to choose more Jurors if they did not like the make-up of the current Jury.
That's why Appellate Courts deny defendant's appeals which are based on a Juries' Race or Gender, etc. if they had any Peremptory Challenges remaining.
to many people in this country try to fight for life in prison after they have commited a murder or murderes if you take a life voluntaraly then i think you should get the death penality, he obviously didnt care about taking their lives, that jury should take his

Do you have any idea when a defendant here in Stark county was sentenced to death. I have heard it from more than one person that juries down here in Stark county don't impose the death penalty?
I've been watching this case very closely and I have to say I do not think the prosecution proved premeditation or intent. Not one of there credible witnesses ever said he was upset at the possibility of another child. They established that at times his relationship with Jessie was not always great but that is alot of relationships where one person is married and the other is not. i really think that murder is the verdict the jury is going to come up with for Jessies death as for the baby I don't know. i just know my heart goes out to both families especially her parents and his children.
I'm here in California which is Home to the the Largest Death Row Population in the Country.
Our Juries certainly Impose the Death Penalty on murderers, but unfortunately our Department of Corrections & our Appellate Courts (State & Federal) do not Enforce the Death Penalty so quickly.
Currently Today - California has 669 - Inmates sitting on Death Row waiting to be executed..... Actually, they are waiting for their Multiple-Appeals to be heard by Multiple-Appellate Courts.
Average Death Row Inmate in California sits on Death Row for 23-25 Years before they exhaust all their State & Federal Appeals.
Then again, it takes about 5-6 Years for a Newly-Admitted Death Row Inmate in California just to be appointed an Appellate Attorney for the first time, so their Appeals Process may begin.

To the one who said they hid bodies they found while hiking...I know it was a joke but may I say that it was not funny. Google "Gary Hilton" and read up on 23 year old hiker Meredith Emerson's death - she went hiking with her dog in N Georgia on New Year's Day and ended up kidnapped, beat to death with a tire iron and decapitated by a crazy 61 year old man who stalked his victims while hiking in the mountains...she is not his only hiker victim. He led them to her body in exchange for life in prison instead of the death penalty; however, there are more murders (also hikers) - he will be charged for their murders and the death penalty will not be removed -the bodies have already been found... in North Carolina, Florida and who knows where else... CHRIS----- HOW LONG WAS THE JURY OUT IN THE SCOTT PETERSON TRIAL?
I think that the longer that the Jury deliberates, then the more it looks like they are leaning towards the defense. Statistically speaking, juries return guilty verdicts faster.
I have seen alot of comments for the death penalty in this case. I recently read a John Grisham book titled the innocent man. It was a true story of a man that spent 11 years on death row, when in fact he was innocent. He was eventually freed.
When reading this book, i was struck by the possibility innocent people possibly being executed. In this case, it almost happened, and caused me to reflect a little. Is the death penalty worth having if 1 innocent person is executed??
For me, the answer is becomming a no. I have always been pro death penalty, but was significently moved by this story, enough so that i am seriously questioning my stance on this type of penalty.
If i was on this jury, i think i would have reasonable doubt at this point. Is it reasonable to think this is a manslaughter rather then a murder? I think it is. I, like everyone that has followed this case, have been moved by what has happened to Jessie Davis. But i also think that the prosecution has very little evidence in this case. They can not determine a cause of death, they are not even sure of when she died. Now that may be due to Bobby's actions, but that doesnt mean that he isnt telling some truth either. Witnesses have repeatedly stated that he has never been witnessed to be violent, and i could go on and on, but all of those things have credibility. I am by no means a pro-defendant person, but i believe that the government has to prove beyond ANY REASONABLE DOUBT that a person is guilty. I question whether or not they have accomplished this in this case??

Now that OJ is back in the news...again...we are reminded that a jury let him go to continue his violent ways - when he was so obviously guilty - just like Cutts. It has left me with an uneasy feeling about the verdict in this case. However, no matter which way the jury swings, it should be clear to all that we never do really "get away with" doing wrong...it always catches up. First and foremost, there's our heavenly Father that will be waiting in judgement...and, OJ hasn't had a moments peace due in large part to the family's of his murder victims. He would have been better off in prison...and it just keeps getting worse for him and will never stop. As for the child, Blake, there are children that grow up just fine without one or other parent - expecially when it's in the child's best interest to keep one or the other away. Cutts proved he had no rights to the child when he allowed him to witness hauling his dead mother and baby sister off in a blanket and left him alone in a home with a loaf of bread for nourishment...God be with that child if he actually witnessed the murder of his Mommmy.
What is this that I have been hearing in regards to one of the jurors actually being involved in the initial search of the body last summer? How could of either the defense and the prosecution approve this juror for the case? Was this person removed?

Chris, i am assuming the verdict will be on the internet as video, like the testimony etc.? and, if so, will it stay on as a link for awhile, in case i miss it? i've been trying to keep up with your blog while working in Topeka, KS, and it isn't covered here in the news that much so i doubt i will know from local news right away if a verdict has been reached.
also, it bothers me how long this it taking too, but are there only three choices here? aggrevated murder, murder, or innocent? obviously he can't be found innocent since he admitted the killings, but if nobody on the jury feels that even the murder charge is appropriate, this could end up a hung jury and they'd have to start all over again, right? is that how that works? or is a hung jury a presumption of innocense and he gets out?
if he DOES have to wait for another trial due to a hung jury, can they then use all the testimony that Bobby Cutts gave that differed from Myisha FErrell's, and then question Myisha again in court about what Bobby said, and ask her if that is true? or does all the evidence have to stay exactly as it began in this trial?
sorry, i know little about the process of trials, and luckily i have had no reason to know the legal system well enough to understand how any murder trial works.

Did everyone see Bobby Cutts Refuse to Stand for the Jury while the Jury was Exiting ??
Cutts stood all the other times while the Jury Entered & Exited the Courtroom.

The love he has at two year's old for a dad who left him alone in a house for more than a day, filled with bleach and bleach fumes, who was not a "top priority" (Cutts' own words)? Do you really believe that's a dad he should feel love for when that same dad didn't even acknowledge this little boy's right to safety and a healthy happy mother? Just food for thought! Also, it is not hard to believe that he does not ask for his dad - look at the type of father he proved to be even before this case.
P.S. - UD DOJ - I enjoy your posts - you seem like a thoughtful intelligent person :o)
If Bobby were to "accidently" kill her, any police man would abviously now to call for help.
